New housing: the ten-year cover

For new housing, the builder or seller must cover the owners' patrimonial damages if, within ten years of the certificación técnica de ocupación, the building falls into ruin or threatens to through defects of construction, of the soil or of the materials (Ley 1796 de 2016, art. 8; Código Civil art. 2060 num. 3).

Decreto 282 de 2019 regulates how that cover is given (insurance, bank guarantees or other financial products). Ask the builder which one your home has.

The legal warranty of a home

For a home, the legal warranty covers the stability of the work for ten years and the finishes and the vital lines for one year (Ley 1480 de 2011, art. 8; Decreto 1074 de 2015, art. 2.2.2.32.3.3).

The terms count from the delivery of the home. Keep the delivery record (acta de entrega): its date is the one the app uses.
